In Rowan County, Kentucky, County Clerk Kim Davis is being held in jail after being found in contempt of court Thursday morning for refusing to issue same-sex marriage licenses to gay couples.
Davis commented that granting marriage licenses to LGBT couples would “violate God’s definition of marriage” and go against her beliefs.
Bunning said Davis would be released only when she agreed to follow his order and issue marriage licenses. “I myself have genuinely held religious beliefs,” Bunning said, “but I took an oath.”
According to an article published by NBC News, Bunning told Rowan County deputy clerks that they must issue marriage licenses to gay couples or else they will face fines or jail time. Five of the six deputy clerks have complied with the judge’s order.
Some had mixed emotions about Bunning’s decision.
Deputy Clerk Melissa Thompson mentioned to Bunning, “I’m a preacher’s daughter, and this is the hardest thing I’ve ever had to do in my life.”
The one deputy who did not comply with Judge Bunning was Nathan Davis, Kim Davis’ son.
Davis’ son told Bunning Thursday afternoon, “I do not accept compliance.”
Davis was elected as Deputy Clerk back in November. As an elected official, Davis can only be removed in a vote by state legislators, who don’t reconvene in the State House until January, according to NBC News.
Bunning accepted her attorney’s proposal to allow her out of custody if she complied to not interfering with the issuing of marriage licenses for gay couples. After being ordered to return to court, Davis attorneys said that she would not make any representation for the licenses, thus not accepting the compromise that would have released her from custody.
Currently, Davis is still in contempt and will remain in jail.
